Highmark Engineering Services Ltd (“we”, “us”, “our”)

1. About Us

Highmark Engineering Services Ltd provides surveying and engineering services across the UK, including: • Topographical Surveys • 3D Cut & Fill Modelling • Setting Out • As‑Built Surveys • Other related engineering services

Registered in the UK as a Limited Company.

2. How We Work

2.1 Quotes & Instructions

• All work begins only after you receive a written quote and confirm acceptance by email. • Email confirmation of the final details counts as a binding agreement. • Quotes are valid for 30 days unless stated otherwise.

2.2 Deposits & Payments

• A deposit may be required before work is scheduled. • Remaining balance is due upon completion of the agreed work or as stated on the invoice. • Payments must be made by bank transfer unless otherwise agreed.

3. Cancellation Policy

• Customers may cancel with a minimum of 7 Day's notice before the scheduled start date. • If a deposit has been paid, it is non‑refundable. • If cancellation occurs within 48 hours of the start date, we reserve the right to charge for any time already allocated, preparation work completed, or travel costs incurred.

4. Our Responsibilities

4.1 Standard of Service

We provide all services with reasonable skill and care, in line with UK law (Consumer Rights Act 2015).

4.2 No Warranties

• We do not provide any guarantees or warranties beyond reasonable skill and care. • We do not guarantee planning approval, design outcomes, or third‑party decisions. • As‑built surveys are provided only as proof of work carried out, based on the information available at the time of survey.

5. Client Responsibilities

You agree to: • Provide safe and unrestricted access to the site. • Ensure all necessary permissions to enter the land are in place. • Provide accurate information about site conditions, boundaries, and hazards. • Notify us of any changes to the site before work begins.

If access is restricted or unsafe, we may reschedule or charge additional costs.

6. Deliverables

Depending on the service, deliverables may include: • Survey drawings • 3D models • Cut & fill calculations • As‑built documentation • Setting‑out coordinates

All deliverables will be provided in the agreed format (e.g., PDF, DWG, CSV).

7. Liability

• We are not liable for delays caused by weather, site conditions, third parties, or incomplete information provided by the client. • We are not responsible for any loss arising from the client’s use of survey data for purposes other than those originally intended. • Our total liability is limited to the value of the contract for the specific work carried out.

8. Intellectual Property

All drawings, models, and documents remain the property of Highmark Engineering Services Ltd until full payment is received. After payment, you receive a licence to use the deliverables for the intended project.

9. Privacy & Data

We comply with UK GDPR. Any personal or project information you provide is used only for delivering our services. We do not share your data with third parties unless required by law.

10. Complaints

If you are unhappy with any part of our service, please contact us in writing. We will aim to resolve issues promptly and fairly.

11. Governing Law

These Terms & Conditions are governed by the laws of England and Wales. Any disputes will be handled by the courts of England and Wales.
